2. Getting Licenses

Determining zoning status of the land


Investors have various possibilities regarding the preference of the places where the tourism investment is to be made. Investors may use their existing immovable or an immovable to be purchased for investment purposes. Additionally, benefiting from the allocation opportunity in line with the Regulations for Public Immovable Allocation for Tourism Investments, investors may demand the allocation of the treasury lands and forest lands except for the public lands within the Cultural and Tourism Preservation and Development Regions and Tourism Centers. 

 

Zoning plans intended for Cultural and Tourism Preservation and Development Regions are prepared/made prepared and approved by the Ministry of Culture and Tourism. Parcels of land designated with these plans are allocated to investors for certain periods based on allocation agreements. Independent and permanent right of construction in favor of the investor may also be established. Procedures for the allocation of the public lands are arranged by the Regulations for Public Immovable Allocation for Tourism Investments and they are subject to the announcement and preliminary permissions processes stipulated therein.

 

Acquisition of the immovable properties within the Cultural and Tourism Preservation and Development Regions and Tourism Centers may be reserved from the threats related to foreigners included within the Village Law No. 442 and Land Registry Law No. 2644.

 

Zoning plans are requested from the Provincial Directorate of Public Works and Settlement outside the municipality and municipal boundaries. If this plan is concerned with a land within the areas that are not allocated for tourism, the land in question cannot be utilized for tourism investment. In such cases, the preparation of an appropriate zoning plan which will enable the tourism investment is mandatory.

 

For this, it is investigated if there exists a 1/1000 scaled map of the land in question through the help of the municipality, within the municipality boundaries as well as the adjacent boundaries, or of the Provincial Directorates of Public Works and Settlement or Mapping Department of Provincial Bank (İller Bankası), outside the municipality boundaries. If the map does not exist, it is prepared and submitted to the aforementioned authorities for approval. 

 

Preparation of the zoning plans which are related to the pieces of land that are not included in the areas allocated for tourism requires a separate procedure.

 

Apart from these, investors may demand the allocation of the public lands within the Cultural and Tourism Preservation and Development Regions and Tourism Centers, public lands outside these areas and forest lands outside public lands. At this point, too, relevant transactions are subject to the Tourism Encouragement Law and Regulations for Public Immovable Allocation for Tourism Investments.

Preparation of the land zoning plan


In case of the existence of a property right related to an immovable property located within the Cultural and Tourism Preservation and Development Regions and Tourism Centers, preparation of the land zoning plan concerning areas allocated for tourism is fulfilled/is made to be fulfilled by the Ministry and approved ex officio in line with the Regulations for the Preparation and Approval of the Zoning Plans within the Cultural and Tourism Preservation and Development Regions and Tourism Centers and via consulting the comments by relevant agencies and institutions when plans at all scales specified within the Regulations in question are required. Public agencies and institutions, as well as the real persons and legal entities, may also propose plans and plan changes, together with their justifications, at all scales specified within the Regulations in question. The Ministry may make a preliminary compatibility decision, reject the plan or amend the planning limits.

 

In case property right exists related to an immovable property located within the places other than these areas, transactions as for this immovable must be carried out in accordance with the other applicable regulations this immovable is subject to.
